DISCLAIMER: By submitting this application form, I express my desire to participate in the Saturday Night Before Christmas Even Boat Parade (the “Parade”). In consideration of being permitted to participate in the Parade, I agree to all the terms and conditions set forth below. RELEASE OF LIABILITY AND ASSUMPTION OF RISK: I AM AWARE AND UNDERSTAND THAT THE PARADE INCLUDES POTENTIALLY DANGEROUS ACTIVITIES AND INVOLVES THE RISK OF PERSONAL INJURY, PAIN, SUFFERING, TEMPORARY OR PERMANENT DISABILITY, DEATH, PROPERTY DAMAGE, AND/OR FINANCIAL LOSS. I ACKNOWLEDGE THAT ANY INJURIES I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF SATURDAY NIGHT BEFORE CHRISTMAS EVE BOAT PARADE, INC. AND/OR ITS OFFICERS, EMPLOYEES, DIRECTORS, REPRESENTATIVES, AGENTS, PARADE PARTICIPANTS, PARADE GUESTS, PARADE ORGANIZERS, OR PARADE SPONSORS, AND THE EMPLOYEES, AGENTS, PARTICIPANTS AND GUESTS OF ANY PARADE ORGANIZERS AND PARADE SPONSORS (COLLECTIVELY, THE “PARADE PARTY”). NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE PARADE WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE PARADE, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OR GROSS NEGLIGENCE OF THE PARADE PARTY OR OTHERWISE. WAIVER: I hereby expressly waive and release any and all claims, now known or hereafter known, against the Parade Party arising out of or attributable to my participation in the Parade, whether arising out of the ordinary negligence or gross negligence of the Parade Party or otherwise. I covenant not to make or bring any such claim against the Parade Party, and forever release and discharge the Parade Party from liability under such claims. INSURANCE: I hereby certify that there exists boat insurance for property damage and liability, and that the insurance information I have provided is true and correct. COMPLIANCE WITH LAWS AND PARADE RULES: I hereby acknowledge and understand that I will ensure that at all times during the Parade my passengers, guests, and invitees comply with all federal, state, or local laws, regulations, or codes, and further, that my vessel is in full compliance with all federal, state, or local laws, regulations, or codes. I further acknowledge that I have read, understand, and agree to abide by the rules and guidelines outlined on the website located at www.puntagordaboatparade.com. INDEMNIFICATION: I hereby agree, on behalf of myself, my vessel, and my passengers, guests, and invitees (hereinafter, the “Indemnifying Party”), to indemnify, hold harmless, and defend The Saturday Night Before Christmas Eve Boat Parade, Inc. and its officers, employees, directors, representatives, agents, Parade participants, Parade guests, Parade Organizers, Parade Sponsors, and the employees, agents, participants and guests of any Parade Organizers and Parade sponsors (collectively, the “Indemnified Party” or the “Parade Party”), against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, awards, penalties, fines, costs, or expenses of whatever kind, including professional fees and reasonable attorneys’ fees, that are incurred by the Indemnified Party, or otherwise awarded against the Indemnified Party in a final and/or non-appealable judgment, administrative proceeding, or any alternative dispute resolution proceeding arising out of any third-party claim related to the Indemnifying Party’s participation in the Parade and/or alleging (a) any negligent or more culpable act or omission of Indemnifying Party, including any reckless or willful misconduct, in connection with the Parade; (b) any bodily injury, death of any person, or damage to real or tangible property caused by negligent or more culpable acts or omissions of Indemnifying Party, including any reckless or willful misconduct, in connection with the Parade; and (c) any failure by Indemnifying Party to comply with any applicable federal, state, or local laws, regulations, or codes, in connection with the Parade. SIGNBOARDS & LIGHTS: BY SUBMITTING THIS FORM, I AGREE TO BE RESPONSIBLE FOR THE LIGHTS & NUMBER SIGNS PROVIDED, AND I AGREE TO RETURN THEM IN GOOD WORKING ORDER WITHIN 30 DAYS AFTER THE CONCLUSION OF THE PARADE. I FURTHER ACKNOWLEDGE THAT I WILL BE BILLED $30.00 EACH FOR ANY LOST OR DAMAGED SIGNS. I UNDERSTAND THAT MY SUBMISSION OF THIS APPLICATION FORM SERVES AS MY SIGNATURE, AND BINDS ME TO THE TERMS AND CONDITIONS ABOVE, AND, BY SUBMITTING OF THIS APPLICATION FORM, I ACKNOWLEDGE AND AGREE TO THE DISCLAIMER ABOVE, AND ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE PARADE PARTY. *
